Terms of sale

1. Purpose

These General Terms and Conditions of Sale (the “Terms”) govern all purchases made through the website www.hautecondoms.com (the “Site”), operated by Haute Condoms (the “Company”).

By placing an order, the customer expressly acknowledges having read and accepted these Terms without reservation.

2. Products — Pre-Order Model

The products offered are manufactured in limited production runs and made available exclusively through a pre-order system.

By placing an order, the customer acknowledges that:

  • The product is not immediately available for shipment
  • Production is initiated following order aggregation
  • Delivery timelines are indicative and not guaranteed

Estimated delivery timeframe: 3 to 6 months from order confirmation

3. Order Confirmation

Any order placed on the Site constitutes a binding purchase.

The Company reserves the right to refuse or cancel any order in the event of:

  • suspected fraud
  • abnormal order volumes
  • prior dispute with the customer

4. Pricing & Payment

Prices are expressed in euros (€), inclusive of applicable taxes where required.

Payment is due in full at the time of order confirmation.

Accepted payment methods include:

  • Credit/Debit cards
  • Digital wallets (Apple Pay, etc.)
  • Any method made available at checkout

5. Delivery

Products are delivered to the address indicated by the customer at checkout.

Delivery timelines are provided for indicative purposes only.

The Company shall not be held liable for delays resulting from:

  • manufacturing constraints
  • regulatory approvals
  • customs clearance
  • force majeure events (as defined under French law)

6. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code:

  • The customer has a period of 14 days from order confirmation to exercise their right of withdrawal.

However:

  • Once production has commenced, the order may no longer be cancelled due to its customized and limited nature (Article L221-28 exceptions may apply).

7. Returns & Refunds

Due to the hygienic nature of the products:

  • Opened products cannot be returned
  • Returns are accepted only for defective or non-compliant products

Any claim must be made within 7 days of delivery.

8. Liability

The Company shall not be held liable for:

  • indirect damages
  • misuse of the product
  • failure to follow instructions

Products are compliant with applicable standards but do not guarantee absolute protection.

9. Intellectual Property

All elements of the Site are protected under intellectual property law.

Any reproduction or use without prior written consent is strictly prohibited.

10. Governing Law

These Terms are governed by French law.

Any dispute shall fall under the jurisdiction of competent French courts.
